1. Who we are
Clarity First ("Clarity First", "we", "us") is a B2B wholesale polished diamond clearing-price intelligence product operated by Clarity First Research, a Try Ventures initiative. References to the "Service" mean the Clarity First website, valuation tool, dashboards, APIs and related materials.
2. Who the Service is for
Clarity First is offered exclusively to business users acting in the course of their profession. Including independent jewellers, pawnbrokers, estate buyers, diamond dealers and insurers operating in the wholesale polished diamond market. By accessing the Service, you confirm that you qualify and are authorised to bind the organisation you represent.
3. Acceptable use
You agree not to:
- Reverse engineer, scrape or redistribute Clarity First outputs without written consent.
- Use the Service to violate any law, sanctions regime or third-party right.
- Submit content you do not have the right to submit, including PII you are not authorised to share.
- Use the Service to build a competing product.
4. Early access
The Service is currently provided in early access across the United Kingdom and the United States. Features, pricing, availability and data coverage may change at any time. Early access does not constitute a binding commitment to provide ongoing service or specific functionality.
5. Valuations are indicative
Clarity First provides condition-adjusted market intelligence estimates based on publicly accessible wholesale trading data, market-index divergence signals and public auction results. These outputs are indicative only and do not constitute financial, investment, accounting, tax, insurance or formal appraisal advice. See our Disclaimer for the full statement.
6. Intellectual property
All rights in the Service, including models, methodologies, datasets and derived outputs, remain with Clarity First and its licensors. You receive a limited, non-exclusive, non-transferable right to use the outputs internally for your professional activities.
7. Confidentiality
Non-public information disclosed to you through the Service must be treated as confidential and used only for the purposes for which it was provided.
8. Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Clarity First is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our aggregate liability is capped at the fees paid by you in the twelve months preceding the event giving rise to the claim, or £100 if no fees have been paid.
10. Term and termination
We may suspend or terminate your access at any time for breach of these terms or for any lawful business reason. You may stop using the Service at any time.
11. Governing law
These terms are governed by the laws of the jurisdiction in which Clarity First Research is established, without regard to conflict-of-laws principles. Exclusive jurisdiction rests with the competent courts of that jurisdiction.
